Schönbohm: The grounds for the decision have not yet been published, but it seems that the Federal Court of Justice has fully confirmed the judgment of the previous court. I think that the outcome was expected. The basis for a claim under German unfair competition law was not strong, and the arguments in favor of such a claim were too "creative" to meet scrutiny by the Federal Court.
