ICE Countersues Nymex In Price Usage Battle

NEW YORK--The Intercontinental Exchange (ICE) last week countersued the New York Mercantile Exchange (Nymex), accusing it of trying to block ICE’s use of the Nymex settlement prices in order to extend its monopoly in the North American energy OTC and futures markets.

The suit, which focuses on whether Nymex’s settlement prices are copyright-protected, could have a major impact on the financial markets if Nymex wins. David Gilberg, of Sullivan and Cromwell, counsel to ICE, says that while it is
